Texas law allows a school board to deny a charter school’s proposal to purchase a building owned by a school district.

Independent school districts are required to allow charter schools to make an offer for a building that is for sale.

However, a school board is not required to accept the charter school’s proposal.

The law only allows charter schools that operate wholly or partly within the school district to extend an offer.

Charter schools are considered public schools in Texas but operate independently from traditional public school districts.
