Does a legislator violate the oath of office if they share active ICE locations on social media?

The oath requires lawmakers to support, but not assist the actions of, the state and federal constitution. 

Under the Constitution’s Tenth Amendment and the anti-commandeering doctrine, the federal government cannot force jurisdictions to enforce or administer federal laws or programs. 

Washington state goes further. The Keep Washington Working Act (2019) RCW 10.93.160 restricts law enforcement from providing some information to federal immigration enforcement officers. 

Federal criminal obstruction is against the law. Lawmakers are not protected from criminal laws. Obstruction is defined as affirmatively and actively protecting a known fugitive. Not all undocumented residents immigrants are criminals. 

It is unknown whether known criminal fugitives were present or whether the poster (Councilmember Sam Doyle) affirmatively knew who was present when she posted on social media. 

The line between non-cooperation and active obstruction is constantly litigated. It varies based on facts and jurisdiction where allegations are made.
