Is Nevada one of only two states to ratify the Equal Rights Amendment?

By Kristyn Leonard
NO

As of 2020, 38 states have ratified the Equal Rights Amendment. Nevada is one of those states, but took an unusual path to get there.

The ratification deadline for the ERA was 1982. At the time, only 35 states had ratified, missing the 38-state benchmark for national ratification.

Nevada missed the initial deadline, but became the first state in recent years to revive the ERA when, in 2017, both houses of the Legislature voted to ratify it. The amendment had failed in the state in three previous sessions—1973, 1975 and 1977.

Since then, Illinois and Virginia have followed suit, meeting the ratification benchmark four decades after the deadline passed. Lawsuits are ongoing as to whether Nevada and the other states count toward the national ratification benchmark.
