Proposition 128 would give the Arizona Legislature the authority to amend or repeal citizen-led initiatives or referendums if they contain language that the Arizona Supreme Court or U.S. Supreme Court deem illegal or unconstitutional.
The Voter Protection Act, enacted in 1998, prohibits the state legislature from amending or repealing voter-approved ballot initiatives without a vote of 3/4 of the state legislature. If passed, Proposition 128 would keep the Voter Protection Act in place, only allowing for modification after the state or federal Supreme Courts deem language illegal or unconstitutional.
