In an attempt to block the proposal, a group called West Valley Citizens for Responsible Development filed a lawsuit arguing the San Jose City Council erred in approving the project in October 2024. A Santa Clara County Superior Court judge recently rejected the complaints, clearing the way for the development to move forward.

Once construction begins, Costco expects the project to take about 21 months to complete.
