Fact brief: Are there situations where landlords can legally enter tenants’ apartments in Texas without permission?

Texas has no specific laws that regulate when a landlord may enter a rental property, but leases typically allow entry under certain conditions.

Leases contain specific language indicating when a landlord may enter. Exceptions are allowed for repairs and emergencies.

An individual lease may or may not require prior notice to the tenant before landlord entry. 

“Covenant of quiet enjoyment” is an implied promise under the law that tenants have a right to peaceful and quiet enjoyment of their rental property. 

Texas courts ruled the covenant is an implied term in every lease. The landlord may be in breach if they enter the property more often than necessary, at unreasonable times or in violation of the lease agreement.
