Can you legally smoke cannabis on your porch in Colorado?
Colorado state law allows cannabis consumption on private property unless otherwise prohibited by the property owner.
Owners of rental properties have the authority to ban both possession and consumption of cannabis products on their premises. As a home rule state, Colorado cities and counties can also take their own steps to limit or expand where consumption is allowed within their borders.Public consumption in Colorado is prohibited, unless at a licensed marijuana hospitality business. In 2019 the state authorized licensed consumption spaces, such as smoking lounges, contingent on approval from local licensing authorities.
Several cities, including Denver, Black Hawk and Longmont have created their own hospitality licenses, though public consumption is still strictly prohibited by the latter, making it illegal for these businesses to operate.
In 2012, Colorado passed Amendment 64, legalizing the possession and consumption of cannabis for adults 21 and older statewide.
